This correspondence is addressed to Professor Kenneth Russell, Department of Education, Sam Houston State Teachers College from Millard H. Ruud, Professor of Law, University of Texas.
Millard H. Ruud writes to Dr. Kenneth Russell in regards to the Texas Attornery General Opinion No. WW-1195. He states that the opinion says that "no school district, board of education, superintendent, assistant superintendent, principal or other administration shall directly or indirectly" stop or coerce any teacher from "participating in political affairs in his community, state, or nation." Ruud also writes that he and the Attorney General's office believes that this opinion does not included those in higher education.
Ruud mentions that he belives the same rights for public school teachers should be awarded to higher education teachers as well. He also mentions that there is no Texas statue that represents the right of full participation in political affaris for college teachers, but there is legal support for higher education in political protection and the Board of Regents should use this legal support concerning Koeninger's case.
